Introduction

All persons who intend to get married in Fulton County, Georgia must obtain a Marriage License.  This page explains the procedure for obtaining a Marriage License from the Fulton County Probate Court.

Fee

The fee for a Marriage License is $56.  If you present a qualifying premarital certificate, the $40 application fee is waived.  However, the remaining $16 must still be paid for Vital Records Recording and the Children’s Trust Fund Fee. These costs are payable by cash or money order only.

Duration of the Marriage License

Fulton County Marriage Licenses never expires.  A Marriage License issued in Fulton County can be used anywhere within Georgia but may not be used outside Georgia.

Application Procedure

Listed below are the general steps and rules of the application process.  Both bride and groom must appear in person.  If one of you is a resident of Georgia you may apply in any county of Georgia.  If neither are residents of Georgia, you must apply in the county where your ceremony to be held.  Application
In Fulton County, there are three locations where you may obtain your license:

Requirements

You must be at least 18 years of age.

Proper Identification

You must provide proof of your age by providing legal documents which include but may not be limited to: your Driver’s License, passport or birth certificate. Documents which are not in English must be accompanied by a valid English translation.

Blood Test Not Required

As of July 1, 2003, a blood test is no longer required to obtain a Marriage License in the State of Georgia.

Name Change Options

Changing your surname is obtained separate from your license in Georgia.  Once your local Superior Court Clerk has approved the name change, you then need to update your Social Security card, passport, driver’s license and if you desire your birth certificate.

Changing your Social Security information is the primary step.  You will need to send three documents to your local Social Security office proving your name change, identity and U.S. citizenship or immigration status. Send this to the office along with your Social Security card application, which should be returned within 10 business days.

Within 60 days of changing your name, you must obtain a new Driver’s License from your local DDS branch.

Duplicate Marriage License

If, for some reason, you would like to have a duplication or copy of the Marriage License, you must obtain a Certified Copy of the Marriage License.  This is also available from your local Probate Court.  The fee for a Certified Copy of the Marriage License is $10 in addition to the above fees. If you would like the copies to be mailed to you, provide an envelope that is self-addressed and stamped.

Under the Age of Eighteen

Marriage under the age of eighteen is currently non-permissible in the state of Georgia except the child is 16 years of age with consent and both parents appear, unless one of the parents has sole custody.
